Subscription Policy

Overview

This Subscription Policy describes the terms and conditions for purchasing subscriptions through Body Align. This policy is separate from and in addition to our general Terms of Service and Privacy Policy. By checking the subscription consent box at checkout, you acknowledge that you have read, understood, and agree to all terms in this policy.


1. What is a Subscription?

A subscription is a recurring purchase that automatically renews at the end of each billing cycle. Unlike one-time purchases, subscriptions will continue to charge your payment method at regular intervals until you actively cancel.


2. Key Subscription Terms

Billing Frequency

Your subscription will be charged automatically on a recurring basis according to the frequency you selected at purchase. Common billing frequencies include:

  • Every month (Monthly)

  • Every 3 months (Quarterly)

  • Every 6 months (Semi-Annual)

  • Every year (Annual)

The exact billing frequency for your subscription is displayed on your order confirmation and in your customer account portal.

Recurring Charge Amount

The amount charged each billing cycle will be the price shown at the time of your subscription signup, unless:

  • You modify your subscription (e.g., change quantity or product)

  • You redeem a promotional code with an expiration date

  • We notify you of a price change with at least 30 days' written notice

Sales tax, shipping charges, and any other applicable fees will be added to the base subscription price and charged each billing cycle.

Billing Date

Your subscription will be billed on the same day of each billing cycle. For example, if you subscribe on the 15th of the month, you will be billed on the 15th of each month. If your billing date falls on a day that does not exist in a particular month (e.g., the 31st), billing will occur on the last day of that month.

First Charge

The first charge for your subscription will occur immediately upon successful completion of your order, unless a free trial or discount period has been applied to your subscription.


3. How Your Subscription Works

Automatic Renewal

Your subscription will automatically renew at the end of each billing cycle unless you cancel it. You must take affirmative action to cancel your subscription. Cancellation of one billing cycle does not automatically cancel future cycles.

Confirmation Email

Upon subscribing, you will receive an order confirmation email that includes:

  • Your subscription details (product name, quantity, price)

  • Billing frequency

  • Total amount to be charged each cycle

  • How to manage or cancel your subscription

  • Our customer support contact information

Billing Notifications

We will send you an email reminder at least 7 days before each billing date (when applicable based on your subscription settings) to remind you that your subscription will renew.


4. Payment Information

Stored Payment Method

When you subscribe, you authorize us to store your payment method information (e.g., credit card, debit card, or PayPal account) and charge it on each billing date. Your payment information is stored securely according to our Privacy Policy and PCI compliance standards.

Authorization

By checking the subscription consent box and completing your purchase, you give us express, informed consent to:

  1. Store your payment method information

  2. Charge your payment method automatically on each billing date

  3. Continue charging until you cancel your subscription

Declined Payments

If a payment fails (e.g., card declined, insufficient funds), we will:

  1. Notify you by email that the payment was unsuccessful

  2. Attempt to recharge your payment method on subsequent attempts (timing varies)

  3. Provide you with a link to update your payment method

  4. Suspend or cancel your subscription if payment cannot be collected after reasonable attempts


5. Managing Your Subscription

Update Your Subscription

You can modify your subscription at any time through your customer account portal, including:

  • Changing the quantity of items in your subscription

  • Changing the product or variant (if available)

  • Adjusting billing frequency

  • Pausing your subscription temporarily

Changes to your subscription will take effect on your next billing date.

Pause Your Subscription

If you want to temporarily stop your subscription without canceling, you can pause it through your customer account portal. Paused subscriptions can be resumed at any time. Your account will remain active, and no charges will occur while paused.

6. Cancellation

How to Cancel

You can cancel your subscription at any time, effective immediately or at the end of the current billing cycle, at your option. To cancel:

  2. Select the subscription you want to cancel

  3. Click "Cancel Subscription"

  4. Confirm cancellation

Cancellation Confirmation

Once your cancellation is processed, you will receive a confirmation email. No further charges will occur after the cancellation is effective.

No Automatic Renewal After Cancellation

Canceling your subscription stops all future charges. If you have already been charged for the current billing cycle, that charge will not be refunded, but no additional charges will occur.


7. Refunds and Returns

Subscription Purchases

Subscription purchases are subject to our standard Return Policy. However, because subscriptions renew automatically:

Non-Refundable Charges

  • Once a billing cycle has been charged to your payment method, it is non-refundable

  • Refunds are available only for defective or damaged products, in accordance with our Return Policy

  • Canceling your subscription does not entitle you to a refund for the current billing cycle

Defective Products
If you receive a defective or damaged product as part of your subscription, contact us at support@bodyalign.com within 30 days of receipt. We will replace the product or issue a refund for that single shipment at our discretion.

Trial Periods
If your subscription included a free or discounted trial period and you cancel during the trial, you will not be charged. Cancellation must occur before the trial period ends to avoid charges.


8. Pricing and Changes

Price Increases

If we increase the price of your subscription, we will:

  1. Notify you by email at least 30 days in advance of the price increase

  2. Provide a clear description of the new pricing

  3. Give you the opportunity to cancel before the new price takes effect

  4. Continue your subscription at the new price only if you do not cancel

No price increase will occur without your prior notice and consent.

Promotional Pricing

Some subscriptions are offered at promotional prices (limited-time discounts). Promotional pricing is valid only for the specified period. Once the promotional period expires, your subscription will automatically renew at the regular price. We will notify you before the promotional period ends.

Taxes and Fees

Sales tax, local taxes, and other applicable fees are in addition to the subscription price and will be calculated based on your billing address. These may vary by location and will be included in your total charge each billing cycle.


9. Product Availability

Discontinuation or Modification

We reserve the right to discontinue or modify subscription products. If we discontinue a product you are subscribed to, we will:

  1. Notify you by email as soon as possible

  2. Offer a similar alternative product (if available)

  3. Allow you to cancel without penalty

  4. Not charge you for a product that is no longer available


10. Disputes and Chargebacks

Chargeback Disputes

If you dispute a subscription charge through your credit card company or bank (a "chargeback"), we will:

  1. Provide documentation of your express consent to the subscription terms

  2. Submit evidence that the charge was authorized and valid

  3. Work with your financial institution to resolve the dispute

Repeated chargebacks or disputes may result in the cancellation of your subscription and your account.

11. Privacy and Data Security

Payment Information Security

Your payment information is stored securely and processed in compliance with:

  • PCI Data Security Standard (PCI DSS)

  • Industry-standard encryption protocols

  • Our Privacy Policy

We do not store full credit card numbers. Only the last four digits are retained for reference.

Personal Information

Your personal information is collected and used only as described in our Privacy Policy. We will not share your payment information with third parties except as necessary to process your subscription and as required by law.

Communication Preferences

By subscribing, you consent to receive:

  • Order confirmations and receipts

  • Shipping notifications

  • Billing reminders and updates

  • Account and security alerts

You may opt out of promotional emails but cannot opt out of transactional emails related to your subscription.


12. Liability and Disclaimers

Service Interruptions

While we strive to provide uninterrupted service, we are not liable for:

  • Temporary service interruptions

  • Payment processing delays due to third-party payment processors

  • Issues caused by your payment method expiration or closure

  • Shipping delays or delivery failures

Your Responsibility

You are responsible for:

  • Maintaining accurate and current payment information

  • Monitoring your account for unauthorized access

  • Reporting errors or fraudulent activity immediately

  • Canceling your subscription if you no longer want to renew

  • Reviewing charges on your monthly billing statement

  • Provide express informed consent to recurring charges

  • Cancel your subscription easily at any time

  • Receive confirmation of cancellation

State Law Compliance

This policy complies with state automatic renewal laws, including the California Consumer Legal Remedies Act and similar laws in other states. Additional rights may apply depending on your state of residence.

We may update this Subscription Policy at any time. If we make material changes to the terms of your subscription (e.g., increased price, change in billing frequency), we will notify you by email at least 30 days in advance.

Your continued subscription after changes are posted constitutes your acceptance of the updated policy.
